The Christian Action League is recognized as a 501(c)4 non-profit organization according to the Internal Revenue Code. Contributions to a 501(c)4 are not tax-deductible, whether made by individuals or corporations. However, these organizations enjoy considerable freedom to engage in political and lobbying activities. They can support or oppose both legislation and political candidates, provided that such election-related activities do not constitute their primary focus. Churches can donate to the Christian Action League without jeopardizing their tax-exempt status. Churches are permitted to engage in lobbying and influence public policy as long as these activities are relatively minor. A 1955 federal appeals court ruling established that churches spending up to 5% of their budget on lobbying activities, such as supporting the Christian Action League, do not risk loss of their tax-exempt status. This threshold can be as high as 15%, according to IRS guidelines, without violating the “substantial part” test. Legal precedents include Haswell v. U.S., where spending 16-20% of a budget on lobbying was deemed excessive, and Murray Seasongood v. Comm’r, where spending less than 5% was considered acceptable.
